When estimating appropriate settlements amounts in personal injury claims, many attorneys use multiplier. By using a multiplier, an attorney can calculate what amount would constitute a fair settlement including pain and suffering.
Here’s how it works…
For “soft tissue” injuries like minor cuts and abrasions, bruising, sprains and strains, an attorney might ask for 3 to 4 times the amount of her client’s medical or chiropractic bills. The insurance company adjuster would likely not agree to a multiple of 4, but might agree to a multiplier of 1.5, with both parties finally compromising at a multiple of 2 to 2.5x medical bills.
In more serious “hard injury” cases, the multiplier can rise substantially, from anywhere to 4x, 5x, and much higher.
Your case should be considered a hard injury case. Hospitalization is an indication the infection may have been life-threatening. Fortunately, you didn’t sustain any permanent injuries. As a result, demanding a multiplier of 5 would be a good place to start. That amount would be $90,000.
While it’s unlikely the insurance adjuster will agree to pay that amount, asking for it would not be inappropriate. If you can negotiate a settlement of 3-4 times your medical bills, you should be quite happy. That amount will cover your medical bills, out-of-pocket expenses, lost wages, and your pain and suffering.
